WARNING: THIS IS A LEGALLY BINDING DOCUMENT. BY PURCHASING, POSSESSING, OR USING ANY TEXAS TRIGGERS PRODUCT, YOU AGREE TO ALL PROVISIONS OF THIS WAIVER. READ CAREFULLY BEFORE PURCHASING.

• 1. SCOPE OF THIS WAIVER
  This Waiver, Release, and Assumption of Risk Agreement (“Waiver”) applies to all products sold, distributed, or manufactured by Texas Triggers (“TT”), including but not limited to:
  • Forced Reset Triggers (FRTs) and Trigger Assisted Reset Systems (T.A.R.S.) • All trigger components and firearm accessories • Magazines, feeding devices, and firearm parts • Knives, edged tools, and tactical accessories • Any other product offered by Texas Triggers now or in the future
  This Waiver applies to the original purchaser and to any person who receives, borrows, uses, or comes into possession of any Texas Triggers product.
• 2. INHERENT RISKS & WARNING
  FIREARMS, FIREARM ACCESSORIES, EDGED TOOLS, AND RELATED PRODUCTS ARE INHERENTLY DANGEROUS. IMPROPER USE, MISUSE, OR UNTRAINED USE OF ANY TEXAS TRIGGERS PRODUCT MAY RESULT IN PROPERTY DAMAGE, SERIOUS PERSONAL INJURY, OR DEATH TO YOURSELF OR OTHERS.
  You acknowledge that:
  • Trigger systems, including FRTs and T.A.R.S. devices, are capable of cycling at a rapid rate and require proper training and understanding before use • All firearm accessories must be used in strict accordance with applicable laws and safe firearm handling practices • It is your sole responsibility to ensure the safe handling of any firearm equipped with a Texas Triggers product • Texas Triggers products are designed for use by trained, responsible adults who understand firearm safety
  NEVER RELY ON MECHANICAL SAFETY FEATURES AS A SUBSTITUTE FOR SAFE FIREARM HANDLING. ALWAYS TREAT EVERY FIREARM AS IF IT IS LOADED.
• 3. ACKNOWLEDGMENT & ASSUMPTION OF RISK
  By purchasing or using any Texas Triggers product, YOU VOLUNTARILY AND KNOWINGLY acknowledge and assume all inherent and associated risks, including without limitation:
  • Risk of personal injury, including serious injury or death • Risk of property damage • Risk of liability arising from the use of the product • Risk of legal consequences resulting from possession or use of the product in your jurisdiction • Risk arising from improper installation, whether self-installed or installed by a third party • Risk arising from use with incompatible firearms or components
  You acknowledge that Texas Triggers has not provided you with firearm training, and that it is your responsibility to fully understand the operation of any firearm equipped with a Texas Triggers product before use.
  IMPROPER UNDERSTANDING OF HOW ANY TEXAS TRIGGERS PRODUCT OPERATES MAY LEAD TO UNINTENTIONAL OR NEGLIGENT DISCHARGE OF A FIREARM AND MAY RESULT IN SERIOUS INJURY OR DEATH. THIS PRODUCT IS INTENDED FOR USE BY TRAINED, RESPONSIBLE ADULTS ONLY.
• 4. LEGAL COMPLIANCE — BUYER’S RESPONSIBILITY
  IT IS YOUR SOLE RESPONSIBILITY to ensure that you are in compliance with all applicable federal, state, county, and municipal laws at all times regarding the purchase, possession, installation, and use of any Texas Triggers product. Some states, counties, and municipalities prohibit or restrict the possession or use of certain firearms accessories.
  Texas Triggers is not responsible for any fines, penalties, criminal charges, civil liability, or legal consequences arising from your purchase, possession, use, or transfer of any Texas Triggers product in violation of applicable law.
• 5. WAIVER OF CLAIMS
  By purchasing or using any Texas Triggers product, you waive, release, and forever discharge Texas Triggers and its officers, directors, employees, owners, members, managers, partners, shareholders, independent contractors, affiliated entities, parent companies, subsidiaries, insurers, successors, and assigns (collectively, “Released Parties”) from any and all claims, actions, damages, liabilities, losses, costs, and expenses — including reasonable attorneys’ fees — for:
  • Death, personal injury, or illness • Property damage or loss • Legal fines, penalties, or consequences imposed by any government entity • Any claims arising from your use, misuse, improper installation, or possession of any Texas Triggers product • Any claims arising from the transfer of any Texas Triggers product to another person
  You agree to limit Texas Triggers’ liability to actual damages arising solely from gross negligence or willful misconduct by Texas Triggers. In no event shall Texas Triggers be liable for any special, incidental, punitive, or consequential damages.
• 6. INSTALLATION DISCLAIMER
  Texas Triggers strongly recommends professional installation of all trigger systems and firearm accessories by a licensed gunsmith. Texas Triggers assumes no liability for injury, firearm damage, malfunction, or death resulting from self-installation or third-party installation of any Texas Triggers product.
  Texas Triggers may offer in-person installation services on a case-by-case basis, including accepting firearms shipped to our facility for installation. Any such service requires execution of a separate Installation & Service Agreement. Texas Triggers assumes no liability for:
  • Firearms or components lost or damaged during transit to or from our facility • Pre-existing defects or damage discovered during the installation process • Malfunctions resulting from the condition of the customer’s firearm or incompatible components
  Instructional installation videos provided by Texas Triggers are offered as a courtesy resource only. Viewing these videos does not constitute a guarantee of successful installation and does not create any liability on the part of Texas Triggers for outcomes resulting from self-installation.
• 7. INDEMNIFICATION
  By purchasing or using any Texas Triggers product, you agree to indemnify, defend, and hold harmless the Released Parties from and against any and all claims, damages, liabilities, losses, costs, and expenses — including reasonable attorneys’ fees — arising out of or related to:
  • Your purchase, possession, use, or misuse of any Texas Triggers product • Your violation of any applicable law or regulation • Any fines or penalties imposed upon you by any government entity arising from your use of a Texas Triggers product • Your transfer of any Texas Triggers product to any third party • Any injury, death, or property damage caused by your use of any Texas Triggers product
• 8. TRANSFER OF PRODUCT
  If you sell, lease, gift, lend, or in any way transfer any Texas Triggers product to another person, you agree to:
  • Inform the recipient of all risks associated with the product • Ensure the recipient agrees in writing to the terms of this Waiver and Release prior to the transfer • Ensure the recipient is legally permitted to possess the product in their jurisdiction
  Failure to obtain the recipient’s written agreement to this Waiver renders you personally liable for any claims or damages arising from the recipient’s possession or use of the product.
• 9. BINDING EFFECT
  This Waiver shall be binding upon you and your heirs, personal representatives, beneficiaries, next of kin, and assigns, and shall inure to the benefit of Texas Triggers and its successors and assigns. By purchasing or retaining any Texas Triggers product, you voluntarily agree to all provisions of this Waiver.
• 10. DISPUTE RESOLUTION & BINDING ARBITRATION
  To the extent permitted by applicable law, any dispute, controversy, or claim arising out of or relating to any Texas Triggers product, this Waiver, or any breach thereof, shall be resolved by binding arbitration in accordance with the Commercial Arbitration Rules of the American Arbitration Association. Arbitration shall be conducted under Texas Rules in Tarrant County, Texas.
  BY AGREEING TO THIS WAIVER, YOU GIVE UP YOUR RIGHT TO RESOLVE ANY DISPUTE THROUGH A COURT OF LAW BEFORE A JUDGE OR JURY. YOU ALSO WAIVE YOUR RIGHT TO PARTICIPATE AS A CLASS REPRESENTATIVE OR CLASS MEMBER IN ANY CLASS ACTION LAWSUIT OR CLASS ARBITRATION. ALL CLAIMS MUST BE BROUGHT INDIVIDUALLY.
• 11. GOVERNING LAW
  This Waiver shall be governed by the laws of the State of Texas, without regard to conflict of law principles. Any legal action not subject to arbitration shall be brought exclusively in the state or federal courts of Tarrant County, Texas.
• 12. SEVERABILITY
  If any provision of this Waiver is found to be invalid or unenforceable, such provision shall be modified to the minimum extent necessary to render it enforceable, and the remaining provisions shall continue in full force and effect.
• 13. NO ORAL MODIFICATIONS
  This Waiver may not be modified orally. No changes to this Waiver may be implied by conduct. Any modification must be made in writing and signed by an authorized representative of Texas Triggers.
• 14. ELECTION — IF YOU DO NOT AGREE
  If for any reason the terms of this Waiver are unacceptable to you, DO NOT PURCHASE OR USE ANY TEXAS TRIGGERS PRODUCT. If you have already purchased a Texas Triggers product and do not agree to the terms of this Waiver, we encourage you to destroy the product, transfer it to an eligible person in accordance with Section 8, or contact your retailer to determine their applicable return policy.
  THIS IS A WAIVER AND RELEASE OF LIABILITY. BY PURCHASING, USING, OR RETAINING ANY TEXAS TRIGGERS PRODUCT, YOU VOLUNTARILY AGREE TO ALL PROVISIONS OF THIS DOCUMENT AND ACKNOWLEDGE THAT YOU HAVE GIVEN UP SUBSTANTIAL LEGAL RIGHTS.
